Copyright & Takedown Policy

How to report copyright infringement on BlablaDeal.

1. Overview

BlablaDeal respects the intellectual property rights of others and expects its Users to do the same. This Copyright & Takedown Policy outlines how we handle claims of copyright infringement on the Platform.

This policy is designed to comply with both:

  • The United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512, for international coverage and Users in jurisdictions that follow DMCA procedures;
  • The EU Copyright Directive (Directive (EU) 2019/790), in particular Article 17 regarding the use of protected content by online content-sharing service providers;
  • The EU E-Commerce Directive (Directive 2000/31/EC), which establishes the notice-and-takedown framework for intermediary service providers in the European Union.

If you believe that content on the Platform infringes your copyright, please follow the procedures described below.

If you believe that content hosted on or accessible through the Platform infringes your copyright, you may submit a written notice to our designated agent. Your notice must include the following information:

  • Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple works are covered, a representative list of such works.
  • Identification of the infringing content: The specific URL(s) or other sufficient identifying information to enable us to locate the allegedly infringing content on the Platform.
  • Your contact information: Your full name, postal address, telephone number, and email address.
  • Statement of good faith: A statement that you have a good-faith belief that the use of the copyrighted material is not authorised by the copyright owner, its agent, or the law.
  • Statement of accuracy: A statement, made under penalty of perjury (for DMCA purposes), that the information in the notification is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  • Signature: Your physical or electronic signature (or the signature of a person authorised to act on your behalf).

Upon receipt of a valid notice, BlablaDeal will promptly investigate the claim and, if appropriate, remove or disable access to the allegedly infringing content.

3. Counter-Notification Procedure

If you believe that content you posted on the Platform was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification. Your counter-notification must include:

  • Identification of the removed content: A description of the content that was removed or disabled and the location at which it appeared before it was removed.
  • Your contact information: Your full name, postal address, telephone number, and email address.
  • Statement of good faith: A statement, under penalty of perjury (for DMCA purposes), that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the courts in your district (or, for EU residents, the courts of competent jurisdiction in your Member State of residence), and that you will accept service of process from the person who provided the original infringement notice.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, BlablaDeal will forward it to the party that filed the original notice. If the original complainant does not file a court action within ten (10) to fourteen (14) business days (as applicable under the DMCA), we may restore the removed content.

4. EU-Specific Provisions

In accordance with Article 17 of the EU Copyright Directive (Directive (EU) 2019/790), BlablaDeal:

  • Makes best efforts to obtain authorisation from rights holders for the use of copyrighted works on the Platform, where applicable;
  • Acts expeditiously to remove or disable access to infringing content upon receiving a sufficiently substantiated notice from a rights holder;
  • Makes best efforts to prevent the re-upload of content that has been the subject of a valid takedown notice, using proportionate and effective measures.

Complaint and Redress Mechanism for EU Users

If you are an EU-based User and your content has been removed or restricted as a result of a copyright claim, you have the right to:

  • Submit a complaint through our internal complaint-handling mechanism by contacting [email protected]. We will review your complaint promptly and without undue delay.
  • Request human review: All complaints are reviewed by a qualified member of our team — decisions are not made solely by automated means.
  • Seek out-of-court redress: If you are not satisfied with the outcome of our internal review, you may submit your dispute to an independent out-of-court dispute resolution body in accordance with Article 17(9) of the Copyright Directive.
  • Access judicial remedies: You retain the right to bring legal proceedings before the competent courts in your EU Member State of residence.

BlablaDeal is committed to ensuring that its content moderation practices respect the fundamental rights of Users, including the right to freedom of expression and information.

5. Repeat Infringer Policy

BlablaDeal maintains a policy for the termination of accounts belonging to Users who are repeat infringers of copyright.

Specifically:

  • A User who receives two (2) or more valid copyright infringement notices within a twelve (12) month period will be considered a repeat infringer.
  • Upon identification as a repeat infringer, BlablaDeal may, at its sole discretion, suspend or permanently terminate the User's account and their ability to access or use the Platform.
  • Account termination under this policy is without prejudice to any other rights or remedies available to BlablaDeal or to the copyright holder under applicable law.

BlablaDeal will consider any counter-notifications, complaints, or extenuating circumstances before taking action under this policy.
